3. How We Use Your Information.
We collect the categories of your information described in PERSONAL INFORMATION WE COLLECT to provide, maintain, and improve our Sites and Services, to promote our products and Services, and to communicate with you, for the following purposes, to:

3.5 Analytics, Profiling, and Automated Decision-Making:

We use analytics and profiling, meaning automated processing of personal information to analyze, evaluate, or predict aspects of an individual’s preferences, behavior, or needs, to operate, secure, and improve our Services. This includes evaluating information such as account details, device identifiers, service-usage patterns, network and performance data, and customer-interaction history. We use these tools to help detect and prevent fraud or security risks, verify account activity, support customer service, maintain and troubleshoot our network, and improve the quality and functionality of our products and Services. We may also use analytics to tailor certain communications or to measure or deliver advertising where permitted by law.

Where U.S. state law defines or treats profiling as part of automated decision-making or targeted advertising, we provide the disclosures and rights required by applicable law. These may include the right to request information about the categories of personal information used in profiling, the right to access information about the outcome of profiling, the right to appeal or seek human review of a decision, and the right to opt out of targeted advertising or the use of personal information in profiling to the extent permitted by law. We do not rely solely on automated systems to make decisions that deny or restrict your access to our core wireless Services.

We use customer proprietary network information (CPNI) only as permitted by federal law. We do not use call-detail or similar CPNI data for marketing non-communications Services without the appropriate consent. Please see Our Obligations and Your Rights Related to CPNI for more information.

Where U.S. state law provides rights to opt out of the use of personal information for targeted advertising, profiling, or the sale or sharing of personal information—including through browser signals such as the Global Privacy Control (GPC)—you may exercise those rights by clicking the “Do Not Sell or Share My Personal Information” link at the bottom of our website or by enabling an authorized preference signal in your browser. Please see Global Privacy Control for more information.

4. How We Disclose/Share Your Information.
While we do not sell your personal information in exchange for monetary consideration, we may disclose the categories of your information described in PERSONAL INFORMATION WE COLLECT to certain third parties in support of our business operations. Under U.S. state privacy laws, like the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (the “CCPA”), that disclosure may be considered a “sale” of personal information, even if no money changes hands.

Categories of information we may disclose to third parties depend upon the types of those third parties and their relationship with us. Categories of information we may disclose to these third parties include those described in PERSONAL INFORMATION WE COLLECT. We may disclose your information for a variety of business purposes, including to the following third parties:

This may include cookies, web beacons, pixel tags, log files and other technologies that automatically collect your information. These companies may combine the information we provide them with the information they have to provide relevant advertising to you. Where these disclosures constitute the “sale” or “sharing” of personal information or processing for “targeted advertising” under applicable law, you may opt out as described in STATE-SPECIFIC PRIVACY DISCLOSURES and Global Privacy Control. We may disclose your information to the following marketing and analytics companies:

  • Digital advertising platforms for serving you cross-context behavioral or targeted advertising.

5. Our Obligations and Your Rights Related to CPNI.
As a telecommunications provider, Consumer Cellular collects Customer Proprietary Network Information (CPNI), which receives special legal protection under federal law.

CPNI includes:

  • Information about the quantity, technical configuration, type, destination, location, and amount of use of your telecommunications services.
  • Billing information related to your telecommunication services.
  • Call detail records (CDRs) showing phone numbers you call and receive calls from, along with the date, time and duration of the calls.
  • Data usage patterns and technical service configuration.
  • Network performance information related to your specific service.

CPNI does not include:

  • Your name, address, and listed phone number.
  • Text message content.
  • Data usage (i.e., internet browsing).
  • Subscriber list information.
  • Marketing and promotional preferences.
  • Customer support interaction records.

Confidentiality of CPNI. Under federal telecommunications law, Consumer Cellular must treat CPNI confidentially and cannot share it without your consent except in specific circumstances:

  • To protect our rights and property or prevent fraudulent or unlawful use.
  • For billing, collection and providing Services to you.
  • To provide emergency information to law enforcement.
  • As otherwise required by law.

We will not disclose your CPNI to you until you have provided us with your password or other permissible authentication measures.

Your Rights Related to CPNI: You have the right to restrict our use of CPNI for marketing purposes. We may use your CPNI for the purpose of offering products and services to you that are related to the communication services we already provide you, subject to your right to opt-out of the use of your CPNI for marketing purposes. You can submit an opt-out request by contacting us via email listed in HOW TO CONTACT US. We do not use CPNI for marketing purposes to offer products and services that are unrelated to our communication services.

6. Marketing Communications, Sweepstakes and Contests.
In accordance with our Wireless Customer Agreement at consumercellular.com/agreement, you consent and agree to receive automated marketing emails and text messages from us sent to your email address and phone number.

You may choose to limit or revoke your consent as follows:

We will process the opt-out request as soon as reasonably possible and within the specific time periods required by applicable law. Please note that by opting out of receiving marketing communications for us, it will not have an impact on your services, nor will it prevent us from sending you non-promotional messages related to your account, transactions, customer support, or Consumer Cellular’s ongoing business relationship with you.

When you register to participate in our sweepstakes, contests and other promotions, we may require your name, postal address, phone number, email or other personal information which allows us to administer and manage the promotion, contact you if you are the winner, or send special offers and other marketing materials to you if you choose to receive them from us. If you no longer choose to receive these special offers and other marketing materials from us, you can revoke your consent as set forth herein. Please carefully review the official rules for such sweepstakes or contests as the terms may treat your personal information differently than under this Privacy Policy and apply to your participation in the promotion.

7. How Long We Keep Your Information.
We retain different categories of personal information for specific time periods based on business needs, legal requirements, and regulatory obligations, unless a specific retention period is mandated or permitted under applicable law. Our contracts with service providers require that they only retain personal information for the duration of time necessary to fulfill the purposes described in the contracts.

8. How We Protect Your Personal Information.
We have implemented administrative, organizational, technical, and physical measures designed to protect your information from unauthorized access or improper use. While our security safeguards are intended to maintain the confidentiality and integrity of your information, no security measures are perfect, and we cannot guarantee your personal information will never be disclosed in a manner inconsistent with this Privacy Policy, for example, because of a third party’s unauthorized or unlawful acts. If that were to occur, we will notify you in accordance with applicable law.

The information we collect is stored on servers located in the United States (“U.S.”). Physical and logical access to these databases and servers on which personal information is collected and stored is restricted to those employees, service providers, business partners and other third parties who have a legitimate need to know for the business purposes described in HOW WE USE YOUR INFORMATION. They will only process your personal information on our instructions or as otherwise agreed in our contracts with them. Our contracts with service providers require that they only store personal information on servers located in the U.S. In limited circumstances, our service providers or sub-processors may access or process personal information from outside the U.S. (for example, for customer support or IT functions). However, the CPNI we collect is only accessed and processed from within the U.S.

9. Information Collected by Third Parties, Third-Party Applications, Links to THIRD-PARTY Sites and User Submissions.
When using our services, you may choose to install, access or use services offered by third parties. By using, playing, or downloading such third-party applications, you agree to be bound by the terms of service for those applications. Service providers administering those applications may use tracking technology, such as cookies, to collect information, and location or geolocation data, about you. We encourage you to carefully review the privacy policies of any third-party service you access via our services. These third-party services operate independently of our services, and your information is governed by their terms and conditions, not Consumer Cellular’s.

Our sites may contain links to third-party websites. This Privacy Policy does not apply to these third-party applications or websites, and Consumer Cellular does not control, nor are we responsible for, the content or privacy and security practices of those third-party applications or websites. Any personal information collected through such third-party applications or websites is subject to the applicable third party’s privacy practices, which we encourage you to carefully review.

We may provide websites where you can post information about yourself and others, upload content (such as pictures, videos, audio files, etc.) and post comments or reviews about Consumer Cellular. You are responsible for the content of anything you share with us. Whenever you voluntarily disclose personal information on publicly viewable web pages, that information will be publicly available, can be collected and used by others, and is no longer subject to this Privacy Policy. We cannot control who reads your posting or what others may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. Once you have posted information, you may not be able to edit or delete such information.

We may engage contractors to provide certain services in connection with our products and services, such as providing technical support, hosting, marketing, conducting customer research or satisfaction surveys, and handling order processing or shipping products. For example, if you choose to purchase a product on our sites, you may be directed to one of our e-commerce partners to complete the payment transaction. Consumer Cellular and the pertinent e-commerce partner will need to share the relevant personal information to fulfill the request even if you have opted out of the “sale” or “sharing” of your personal information and they may use that information for its own purposes as described in their own privacy policies (as detailed in LIST OF THIRD-PARTY SUB-PROCESSORS). Not all Consumer Cellular-branded websites and applications utilize such third-party services.

Our third-party emergency response service provider may receive and process certain account and device information to provide its emergency response services. By adding someone to your trusted contacts, you authorize our third-party emergency response service provider to share relevant account information with your contacts as needed for the emergency response services. Additionally, through our caregiver application, we, our third-party sub-processors and/or service providers, may collect location data and alert your contacts using the application when you arrive at or leave certain designated locations. Precise geolocation sharing is permission-based and can be enabled or disabled in the application settings. This location data is considered sensitive personal information, is only used to provide you and your contacts with the emergency response and caregiving services and is permanently removed upon your deletion of the application, subject to applicable law.

10. Information Obtained From Children.
Our Services are not intended for children or minors, and we do not knowingly collect information from anyone under eighteen (18) years of age. If you believe your child has provided personal information to us, please contact us via the email listed in HOW TO CONTACT US, and we will work to delete their personal information in accordance with applicable law.

11. Cookies.
When you visit our Sites, we store and retrieve information on your device’s web browser, in the form of cookies (which are small data files that are downloaded on your computer or device when you visit a particular website), web beacons, tracking pixels, and similar technologies (collectively, “Cookies”). Cookies help websites remember your preferences and track how you use the site. You can disable some types of Cookies by turning them off in your device’s browser.

When you visit our Sites, you consent to the collection of your information using Cookies set on our Sites by us, our marketing and analytics providers and other business partners. Because we respect your right to privacy, and to comply with state-level comprehensive privacy laws, you can choose not to allow some types of Cookies. However, blocking some types of Cookies may impact your experience on our Sites. For more information about Cookies, the Cookies we use, and how to manage their settings, please click on “Do Not Sell or Share My Personal Information” at the bottom of our website. You may also enable the Global Privacy Control (“GPC”) signal on a compatible web browser. Please see Global Privacy Control for more information.

11.1 Types of Cookies: First party Cookies are Cookies set by us on our sites which are commonly required for the functionality and security of our sites. Third party Cookies are Cookies set on our sites by our partners and service providers to provide us with analytics and serve you with relevant advertising and marketing. Third-party Cookies may be governed by each third party’s specific privacy policy.

11.2 Cookie Classifications: We may use the following types of tracking technologies:

Strictly Necessary Cookies: Cookies that are necessary or essential for our Sites to function and cannot be switched off. They are usually only set in response to actions made by you, such as setting your privacy preferences, logging into your account or filling in webforms. You can set your browser to block or alert you about these Cookies, but some parts of our Sites or functionality may not then work. These Cookies do not store any personal information and will always be active.

Functional Cookies: Cookies that enable us to provide enhanced functionality on our sites and personalization. They may be set up by us or by third parties whose services we have added to our sites. If you do not allow these Cookies, then these services may not function properly when you visit our sites. Like Strictly Necessary Cookies, Functional Cookies do not store any personal information.

Performance Cookies: Cookies that allow us to count visits and traffic sources on our sites so we can measure and improve performance. They help us to know which pages are visited the most and least and see how visitors move around our sites. If you do not allow these Cookies, we will not know when you have visited our sites, and we may be unable to monitor their performance.

Targeting Cookies: Cookies that are set through our sites by our advertising partners or by a range of social media services. They can track your browser across other websites and are used by those companies to build a profile of your interests, show you relevant advertisements on other websites and enable you to share our content with your friends and social networks. If you do not allow these Cookies, you will experience less targeted advertising, impact the content and messages you see on the other websites you visit and you may be unable to use or see these social media sharing tools. You can opt out of such targeted advertising by visiting the Digital Advertising Alliance or Network Advertising Initiative websites. You can also opt-out of targeted advertising by clicking on the “Do Not Sell or Share My Personal Information” link at the bottom of our website.

11.3 Do Not Track: Some newer web browsers may have a “Do Not Track” preference or similar signal that transmits a “Do Not Track” header to websites you visit with information indicating that you do not want your activity to be tracked. We do not currently take action to respond to “Do Not Track” signals because a uniform technology or common industry-accepted standard has not yet been developed.

11.4 Global Privacy Control: Our Sites support GPC, which is a browser-based opt-out preference signal that communicates to websites you visit your requests to opt-out from the “sale” or “sharing” of your personal information or processing of your personal information for “targeted advertising.” You can learn more and how to set up GPC by visiting Global Privacy Control at globalprivacycontrol.org.

12. International Transfers.
Consumer Cellular is based in the U.S. and the information we and our service providers collect is stored on servers in the U.S. and governed by U.S. law, which may be different from the privacy laws of the country where you are located. In limited circumstances, our service providers or sub-processors may access or process personal information from outside the U.S. (for example, for customer support or IT functions), subject to contractual requirements and appropriate safeguards. We do not intend to offer our services to residents of countries other than the U.S. and your access to and use of our sites constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of your information, including personal information, in the U.S., or in other countries where our service providers may process data, as described in How Long We Keep Your Information and How We Protect Your Personal Information.

13. State-Specific Privacy Disclosures.
If you are a California resident, please refer to California Privacy Rights for additional notice. This section of our Privacy Policy applies to the residents of certain U.S. states that have enacted comprehensive state-level privacy laws, such as Colorado, Connecticut, Delaware, Iowa, Indiana, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia (which list is non-exhaustive and may expand as additional U.S. state privacy laws are enacted). Under these laws, residents of these states may have additional rights with respect to the personal information collected by businesses, like Consumer Cellular, such as the following, the:

  • Right to confirm whether we process personal information about you and obtain certain information about how we use your personal information, such as the categories or list of third parties to whom we disclose personal information.
  • Right to access your personal information, if applicable, in a portable and readily usable format.
  • Right to delete your personal information.
  • Right to correct your personal information.
  • Right to opt out of “sale” of personal information or processing of personal information for “targeted advertising.”

Not all states have the same laws or afford the same rights for their residents, such as the rights to appeal or correct, though we will try to assist residents of these states with any valid rights requests that are reasonable and practicable. We do not discriminate against you if you exercise any rights described herein or any other rights under applicable law.

13.1 How to Make a Request: As a resident of these U.S. states, you may exercise these rights (which rights may be subject to certain exceptions) by:

Consumer Cellular, Incorporated
Attention: Privacy Office
12447 SW 69th Ave.
Portland, OR 97223

Residents of U.S. states with opt-out rights may elect to opt out of the “sale” or “sharing” of their personal information (as described in How to Make Consumer Requests, Us Responding to Requests & Verification) for certain disclosures to third parties which may be considered a “sale” or “sharing” under applicable law.

Note that some rights are inapplicable to Consumer Cellular’s business practices (e.g., the right to opt out of or contest “profiling” in furtherance of “decisions that produce legal or similarly significant effects”). Unless we notify you separately, we do not process your personal information for “profiling” in furtherance of “decisions that produce legal or similarly significant effects,” as such terms are defined under applicable law. Where such processing is governed separately by U.S. federal law pursuant to an exemption under applicable U.S. state privacy law, such as under the Fair Credit Reporting Act (FCRA), applicable U.S. federal law will apply to your rights and legally required disclosures regarding the collection, use and sharing of your personal information. Please see Analytics, Profiling, and Automated Decision-Making for more information.

13.2 Types of Requests & Verification: You also can exercise your right to opt-out of the “sale” of your personal information or processing of your personal information for “targeted advertising” by clicking on the “Do Not Sell or Share My Personal Information” link at the bottom of our website or by submitting an opt-out request to us. We will respond to requests to opt-out of the “sale” of personal information or processing of personal information for “targeted advertising” within fifteen (15) business days of receipt. Consumer Cellular recognizes GPC signals, which are a way for you to set a “Do Not Sell or Share My Personal Information” preference at the browser level. If your browser or browser extension has GPC enabled, our sites will automatically recognize that signal and opt you out from the “sale” of your personal information or processing of your personal information for “targeted advertising.” Please see Global Privacy Control for more information. Please note, we do not use sensitive personal information to deliver “targeted advertising,” nor do we use or disclose sensitive personal information for purposes other than those permitted by applicable law, without providing any required notice and obtaining any required consent.

Residents of U.S. states with enacted comprehensive privacy laws have the right to appeal our decision to not process your request. You can submit your appeal to privacy@consumercellular.com. In your email, please provide the following information: (1) first and last name; (2) the type of appeal: (i) access, (ii) know, (iii) delete, or (iv) correct; (3) your ID from the original request; and (4) details regarding your appeal (i.e., reason for your appeal to assist us in our investigation). This information will only be used to respond to the request. We must have all this information to investigate your appeal.

For current Consumer Cellular customers, in most cases, the best way to correct your information is to log into your My Account at consumercellular.com/login. Once you are logged in, you will be able to modify or correct your information. For changes that cannot be made through your My Account at consumercellular.com/login, residents of U.S. states with enacted comprehensive privacy laws may also correct or modify your information by contacting customer support via the email listed in HOW TO CONTACT US.

To help protect your privacy and maintain security, we will take steps to verify your identity before processing your privacy rights request to access, know, delete, or correct. When you make a request, you can expect the following, we will:

  • Verify your identity as required under applicable law. We may require you to provide your first and last name, email address, Consumer Cellular account number, postal address, and phone number, to verify your identity.
  • We will confirm receipt of your request within ten (10) days.
  • We will respond to your request within forty-five (45) days of receipt. If necessary, we may take an additional forty-five (45) days should we need to extend the response time and we will notify you during the first forty-five (45) days of the same.

In certain circumstances, a request to exercise your rights may be denied, for example, if we are unable to verify your identity. If we deny your request, we will explain the reason for our denial in our response back to you. If your rights request is denied, you may lodge an appeal with us, subject to applicable law, as described herein.
